These terms
These terms govern your use of this website and, where you hold an account, the XCL Search Intelligence platform. Agency services are governed by the separate agreement signed for that engagement; where the two conflict, the signed agreement takes precedence.
Using the platform
You may add and analyse websites that you own or are authorised to analyse. You must not use the platform to analyse a site without permission, to circumvent another party's access controls, or to generate traffic intended to manipulate a search engine.
You are responsible for keeping your credentials secure and for activity carried out under your account.
What we do not promise
We do not guarantee rankings, traffic, citations in AI answers, or revenue. Search engines and answer engines are third-party systems whose behaviour we do not control.
Analysis output is guidance based on the data available at the time. Where a data source is unavailable, incomplete or supplied by a third party, the report says so, and you should treat it accordingly.
Intellectual property
You keep ownership of your content and data. We keep ownership of the platform, our analysis methods and our published material. Deliverables produced under an agency engagement transfer as set out in that agreement.
Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, our total liability is limited to [the fees paid in the preceding twelve months], and we are not liable for loss of profit, revenue or data that was not reasonably foreseeable.
Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
